Superior Walls by Magnis Inc. ("Superior Walls") Limited Warranty
Superior Walls’ manufactured walls are warranted for 15 years from the date of installation by a Superior Walls Certified Installer to be free from defects in workmanship and materials as well as sidewall groundwater penetration.
This Limited Warranty will only be effective if the Home Owner has completed the attached Warranty Registration Card and Superior Walls has received it, duly completed, by mail at Box 939, Beausejour, Manitoba, Canada, R0E 0C0, by facsimile or by e-mail within 30 days of installation.
Superior Walls shall not be liable for and this Limited Warranty shall not apply or extend to any failure, defect or damage arising from or connected with damage caused by work that is beyond the scope of the Superior Walls installation process. This Limited Warranty will cover only the replacement or repair (at Superior Walls’ option) of those areas of the product found to be defective structurally or where actual sidewall groundwater penetration has occurred.
If a defect in Superior Walls’ product shall occur, it shall be the Home Owner’s responsibility to promptly contact Superior Walls and advise it with the nature of the defect in writing, within 30 days after such defect is, or ought to be, discovered. Unless necessary to prevent imminent additional damage, no repairs should be attempted by the Home Owner or its contractors and Superior Walls will not reimburse the Home Owner for such repairs. If Superior Walls determines that the product is defective, Superior Walls will, at its option, repair, replace, or re-install the product at its cost. This Limited Warranty is the Home Owner’s sole and exclusive remedy, and Superior Walls will not cover any claims for loss of use, property damage, or any other direct, indirect, incidental, consequential, or special damages, losses or expenses alleged to have been caused by the product. This Limited Warranty is contingent upon compliance with the procedures set forth in the Superior Walls’ published guidelines for construction details including building code specifications for perimeter drain placement and site grading, and the Homeowners Maintenance Guide.
This Limited Warranty may be extended to 30 years provided the Home Owner has contracted Superior Walls to construct the entire foundation from excavation to main floor joist system, known as the “CUBE”. To extend this Limited Warranty, Superior Walls must receive notice, on the Warranty Registration Card attached hereto, together with payment in the sum of Two Thousand ($2,000.00) Dollars, within 90 days after the Home Owner takes possession of his/her home. Failure to comply with these requirements shall terminate any obligation of Superior Walls to extend this Limited Warranty.
THIS LIMITED WARRANTY IS PROVIDED IN LIEU OF ANY AND ALL OTHER EXPRESS OR IMPLIED WARRANTIES. THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED.
